Польську компанію Express Media, видавця місцевих газет Express Bydgoski та Nowości – Dziennik Toruński, покарали за публікацію рекламних текстів без належного маркування. Таке рішення стало першим для медіаринку Польщі,пише Мediasapiens
 
Про це повідомляє видання Press з посиланням на рішення Управління охорони конкуренції та споживачів (UOKiK). Видавця зобов’язали заплатити майже 13 тисяч злотих (бл. 3,5 тисячі доларів) штрафу.

Регулятор проаналізував матеріали додатку «Дбай про здоров’я», який розповсюджується разом із газетами. У ньому виявлено рекламні тексти про медичні послуги, які візуально не відрізнялися від матеріалів редакції. Оскільки читачі могли розцінити рекламні матеріали як статті, що підготовлені журналістами, регулятор визнав це прихованою рекламою. На думку UOKiK, текст мав бути промаркований як «спонсорська стаття».

Згідно із польським законом про протидію нечесній конкуренції, реклама продукту в редакційному матеріалі без його виразного маркування є нечесною ринковою практикою та вводить в оману споживача. Закон було ухвалено в 2007 році, однак рішення про штраф за приховану рекламу регулятор прийняв уперше.

Покарання поки що не набуло чинності, оскільки видавець подав апеляцію до суду. Водночас в Управлінні охорони конкуренції підкреслили, що на сторінках згаданих газет перестали публікувати подібні матеріали.
