Тверський районний суд Москви відмовився прийняти позов політика Олексія Навального до президента Росії Володимира Путіна.

Про це на сторінці у Facebook написав юрист «Фонду боротьби з корупцією» Іван Жданов.

Наразі невідомо, на якій підставі суд відхилив позов. Своєю чергою,Жданов підкреслив, що відмова в прийнятті позову «в будь-якому випадку» незаконна, тому Навальний буде її оскаржувати.

За його словами, Стаття 128 Кодексу адміністративного судочинства РФ передбачає кілька підстав для відмови в прийнятті. 

«Справа не підлягає розгляду в порядку адміністративного судочинства. Чи підлягає розгляд позову до Путіна згідно КАС? Звичайно підлягає. Іншого порядку немає. Адміністративна позовна заява подано на захист прав, свобод і законних інтересів іншої особи. Позов поданий на захист прав Навального Навальним. З адміністративного позовної заяви про оскарження дії (бездіяльності) не випливає, що цими діями (бездіяльністю) порушуються або іншим чином порушуються права, свободи і законні інтереси адміністративного позивача. Тобто права Навального не порушені. У позовній заяві ми прямо вказали як саме бездіяльністю і діями Путіна порушуються права Навального. В судовому засіданні і має бути це перевірено», - написав він.
