Министерство экономического развития обнародовало законопроект «О внесении изменений в некоторые законодательные акты Украины о защите авторского права и сопредельных прав в сети Интернет», согласно которому должна усилиться административная ответственность за нарушение авторских прав в интернете.

Если законопроект примут, то субъекты авторского права смогут требовать удаления или ограничения доступа к информации, нарушающей их права, и требовать предоставления идентифицирующей информации пользователя, который разместил эту информацию, сообщает AIN.ua

Проект закона предусматривает штраф от 500 до 1 000 необлагаемых минимумов доходов за невыполнения владельцем веб-сайта требований удалить или предотвратить доступ к информации, нарушающей авторские права. Такой же штраф законопроект определяет за не предоставление владельцем веб-сайта или хостинг-провайдером информации, которая идентифицирует пользователя, разместившего незаконную информацию. Также предлагается наказывать за указание неправдивых данных в случае требования ограничить доступ к ресурсам с контентом, который нарушает права автора.

В случае повторного нарушения авторских прав в интернете, предлагается ввести штраф в размере от 1 000 до 2 000 необлагаемых минимумов. Ту же сумму придется заплатить направившему жалобу, в случае если она будет содержать неправдивую информацию об авторских правах.

Такой штраф может быть наложен и за недобросовестные требования о возобновлении доступа к информации, нарушающей авторские или сопредельные права: «если владелец веб-сайта знал, что информация была удалена или доступ к ней был закрыт без нарушения его прав». Если же владелец веб-сайта на протяжении суток после обращения о нарушении авторских прав ограничит доступ к противозаконному контенту, то штрафом наказываться не будет.

Проект закона «О внесении изменений в некоторые законодательные акты Украины о защите авторского права и сопредельных прав в сети Интернет» предусматривает предоставление нотариусу права описывать доказательства в интернете по обращению заинтересованных лиц.
