Высший хозяйственный суд Украины отказал Минобороны РФ в возмещении ему кабинетом министров долга корпорации "Единые энергетические системы Украины" (ЕЭСУ) на сумму 3 млрд 113,05 млн гривен. Об этом сообщает ИНТЕРФАКС-УКРАИНА.

Соответствующее решение Высший хозсуд принял 6 августа.

В суде отметили, что не соглашаясь с решением суда первой инстанции и постановлением суда апелляционной инстанции, Министерство обороны РФ обратилось в Высший хозяйственный суд Украины с кассационной жалобой об отмене решений Хозсуда Киева от 3 апреля 2014 года, которым по вновь выявленным обстоятельствам было пересмотрено решение от сентября 2012 года, а также постановление Киевского апелляционного хозсуда от 29 мая по этому делу.

"Коллегия судей, принимая во внимание пределы пересмотра дела в кассационной инстанции, обсудив доводы кассационной жалобы, проанализировав из фактических обстоятельств дела применения норм материального и процессуального права при принятии обжалуемых судебных актов, считает кассационную жалобу такой, что не подлежит удовлетворению", - говорится в решении Высшего хозсуда Украины.
