21 июля Верховный Суд Украины удовлетворил жалобу Центральной избирательной комиссии (ЦИК) на решение Шестого апелляционного административного суда Киева от 17 июля о необходимости зарегистрировать беглого внефракционного нардепа Александра Онищенко кандидатом в народные депутаты на досрочных выборах в Верховную Раду.
Как сообщает портал, об этом информирует Центризбирком в Facebook.
"Решением Верховного Суда от 21 июля 2019 года апелляционную жалобу Комиссии на решение Шестого апелляционного административного суда от 17 июля 2019 года, которым ЦИК обязали зарегистрировать Онищенко кандидатом в народные депутаты в ОИО [одномандатный избирательный округ] № 93, удовлетворено. Данное решение Шестого апелляционного административного суда отменено", – сказано в сообщении.
Верховный Суд пришел к выводу, что информация о якобы учебе Онищенко за границей, которая была признана Шестым апелляционным админсудом Киева как вновь открывшееся обстоятельство, была известна ранее.
"В своем решении Верховный Суд установил, что предоставление ненадлежащей правовой оценки установленным фактическим обстоятельствам дела привело Шестой апелляционный административный суд к ошибочному выводу", – отметили в Центризбиркоме.
