Верховний суд Росії відхилив позов керівництва месенджера Telegram, яке просило визнати недійсним наказ ФСБ щодо надання відомству ключів для розшифровки електронних повідомлень користувачів

"Адміністративний позов компанії Telegram Messenger LLP про визнання недійсним наказу ФСБ від 19 липня 2016 року відхилити", - оголосила постанову суддя.

Представник Telegram після оголошення судового рішення повідомив журналістам про намір оскаржити його.

"Ми, як і раніше, вважаємо, що наказ ФСБ порушує цивільні права, і будемо звертатися зі скаргою в апеляційну інстанцію", - сказав юрист компанії.

Компанія Telegram Messenger LLP (Велика Британія) просила Верховний суд Росії визнати наказ ФСБ від 19 липня 2016 року №432 про затвердження порядку подання організаторами поширення інформації в інтернеті даних, необхідних для декодування електронних повідомлень користувачів мережі, недійсним і таким, що суперечить вимозі закону про необхідність судового рішення для доступу до листування громадян.

У жовтні 2017 року суд в Москві визнав компанію Telegram Messenger LLP винною за ч. 2 ст. 13.31 Кодексу РФ про адміністративні правопорушення (невиконання організатором поширення інформації в інтернеті обов'язку зберігати або надавати правоохоронним органам інформацію про факти прийому, передачі, доставки або обробки повідомлень, якими обмінюються користувачі, а також інформацію про цих користувачів) і оштрафував на 800 тис. рублів. Рішення оскаржили, але районний суд визнав його законним, після чого скаргу спрямували ​​до Верховного суду.
