Лицо с не снятой и непогашенной судимостью не может быть президентом Украины.

Об этом заявила министр юстиции Украины Елена Лукаш в комментарии ВВС.

"По моему убеждению, лицо с не снятой и непогашенной судимостью не может быть президентом Украины", - отметила она.

"Это вопрос толкования. Системный анализ Конституции позволяет сделать вывод, что лицу, желающее стать президентом, но имеющее судимость вообще отбывает наказание, будет очень трудно или невозможно стать главой государства", - пояснила Лукаш.

Она напоминает, что президент - это главнокомандующий, лицо, имеющее допуск к государственной тайне.

"Это вопрос правоприменения, и он четко решен в действующем законе о выборах президента Украины", - резюмировала министр.

По ее мнению, даже обращаться в Конституционный суд по этому разночтению не нужно.
