Нацсовет по вопросам телевидения и радиовещания дополнил тремя новыми разделами Инструкцию о проверках телерадиоорганизаций и провайдеров программной услуги.

Об этом говорится в решении № 1019.

Нововведения касаются порядка составления протоколов, рассмотрения дел и оформления материалов об административных правонарушениях и нарушениях законодательства о рекламе,пишет ЮрЛига.

Протоколы составляются уполномоченными лицами Нацсовета по результатам проведенной ими проверки. Если нарушение совершено несколькими лицами, то протокол составляется на каждого из них в отдельности. Правонарушителя знакомят с его правами и обязанностями, о чем делается отметка в протоколе. Лицо может предоставить письменное объяснение и замечания по существу совершенного деяния.

Протокол составляется в 2 экземплярах, один из которых под расписку вручается лицу. К протоколу прилагаются материалы, подтверждающие факты правонарушений. Все документы в течение 10 дней направляются на рассмотрение Нацсовета, который принимает решение, направлять ли протокол в суд или в соответствующий уполномоченный орган.

Делами об административных правонарушениях занимаются судьи районных, районных в городе, городских или горрайонных судов. А дела о нарушении законодательства о рекламе рассматриваютсяГоспотребинспекцией.
